Parnian Terms and Conditions

Orders of items that are in stock require 100% payment that clears our bank before delivery. In stock items can usually be shipped to most locations within 2 to 3 weeks. Items that indicate shipping included are valid for most zip codes in the United States of America. If for some reason your zip code does not qualify for free shipping, a Parnian representative will contact you. Non Stock or special order items require a 50% deposit to order your merchandise. Parnian accepts payment with American Express, Visa and Mastercard when items are being shipped to the same address as the cardholder's billing address and the cardholder is available to sign for the goods. Parnian will require a personal check or money order to clear the bank before delivery of goods to any adress which is different from the cardholder's billing address. When your special order items are ready to ship, a Parnian representative will contact you, and you will be required to pay the remaining balance of your order prior to shipping. Parnian reserves the right to revoke offers or correct errors even if a credit card has already been charged. If for some reason a supplier does not have an item in stock, Parnian will notify you so that you can determine if the wait time is acceptable to you. Parnian has been in business since 1977 and we have an excellent reputation of having a high level of customer service. Payment Terms:
A 50% deposit is required to initiate the sales order for special order items. The balance must be paid no later than two weeks after the merchandise arrives at Parnian’s warehouse. Merchandise will not be scheduled for delivery unless the order is paid in full and all balances have cleared the bank.

Payment of the balance is due upon notification that goods have arrived at the Parnian warehouse. The customer shall be in default if payment is not received by Parnian within (30) days of said notification date. In the event of default this contract shall be placed in the hands of an attorney for collection and suit shall immediately follow to collect any unpaid balance.

Default in making any payment when due or breach by the customer of any part of this agreement or the addition of terms of purchase shall authorize Parnian to take possession of said property immediately without due legal process or order of the court, and all payments made up to the time of default shall be applied as hire for said property and depreciation in value.

In the event of further purchases before this indebtedness is discharged in full, I agree that Parnian shall have a lien on all of said purchases until each purchase is paid in full, hereby waiving my rights as to application of payments. The sales order shall not be subject to change or modification unless such change or modification shall be authorized I writing by an officer of the company and shall be endorsed upon and made a part of this agreement.

Sold To ( The Customer):
The customer agrees that if he or she is married, at the time of purchase, they are both bound by the terms and conditions of this sale. The customer also agrees that if a designer or design firm makes a purchase, on their customer’s behalf, the customer is bound by the same terms and conditions.

Design and retainer fees paid to Parnian are non-refundable. If the customer does not complete the contract and place an order in a timely manner (60 days) these fees will be kept as compensation.

Promise Dates:
Although every effort is made to quote accurate promise dates, these dates are approximate and Parnian can not be held responsible. Promise dates may be subject to delays caused by strikes, lockouts, failures of suppliers, fire, accidents, and acts of God.

“AS-IS” Items:
All “as-is” items are sold in existing condition and are not returnable.

Taxes:
If the Customer claims tax exempt status but fails to provide documentation for such status by the promise date or the date the goods are ready (whichever is first), then the customer must pay all taxes immediately upon notification. If taxes are not paid within one week of notification then the Customer will be considered in default and goods will belong to Parnian. Customer agrees to pay all customs, duties, and/or taxes which may be incurred by any items shipped by Parnian to the customer.

Warehouse Storage:
Parnian will provide complimentary storage of merchandise for 30 days from the date of arrival or promise date, whichever comes later. If, for any reason, the client can not accept delivery and Parnian is required to store their merchandise a charge of 0.5% (half of one percent of the total net price) per week will be charged. This storage and insurance charge must be paid in full prior to delivery arrangements.

Verbal Agreements:
Parnian insists that any modification to the sales order be made in writing. Parnian will not accept verbal changes or agreements. In some cases Parnian will ask the customer to sign a detailed sheet illustrating the custom items to be made for them. Verbal promises or agreements made by Parnian associates are not binding.

Gift Certificates and Store Credits:
Gift certificates and store credits will be valid for 1 year from the issue date. At the conclusion of 1 year, it will expire.

Damage Caused by Carrier:
Any damage must be reported to the carrier at the time of delivery. Any such freight damage must also be noted on the delivery slip, or Bill of Lading, at the time of delivery. Such claims must be taken up with the carrier or delivery service. The original cartoning and packaging must be kept and might be required for inspection. Parnian insists that each carrier inspect (and sign in good condition) your merchandise at the time the merchandise is picked up as we are not responsible for damage in transit to you. Parnian may not be able to assist you with a claim and will not be held responsible if the above procedures are not followed.

Damaged or Defective Merchandise:
In the event that merchandise is found to be defective Parnian Furniture must be notified immediately. The original cartoning and packaging must be kept and might be required for inspection. Parnian reserves the right to repair the defective item(s). Parnian abides by the industry standard of repairing the item before thought is given to replacing the item. Parnian may not be able to assist you with a claim and will not be held responsible if the above procedures are not followed.

Deliveries:
The delivery charges quoted for a Parnian delivery or an Outside Delivery Service do not include 2nd story installation or the hoisting of merchandise from the outside.
Parnian does not assume any responsibility or liability should this be required. There will be an additional charge incurred due to inaccessibility of entry. If the customer asks either Outside Delivery services or Parnian employees to move items not on this sales order, there will be additional charges. If there are any damages due to movement and/or handling of items not on this sales order, Parnian will not be held liable in any way.

There will be a fee for cancelled deliveries that happen within 48 hours of scheduled delivery date and time. The fee will be a minimum $50 rescheduling fee for Parnian deliveries. For Outside Delivery services, their rescheduling fees apply.

Customers Own Material (C.O.M.):
Parnian can not be held accountable for fabrics supplied to us by the customer and to be sent on to an upholstery manufacturer. Since Parnian did not purchase this from its own vendor, we can not guarantee that it is suitable as an upholstery material. The customer agrees that they will pay all shipping costs charged (duties where necessary) to get their C.O.M. to the appropriate factory.

Fabrics or Leather:
Like all Home Furnishing Companies, Parnian Furniture is not responsible for fabrics or leather used in manufacturing upholstery. Parnian will not be held responsible for fabric and leather since we can not determine the manner in which the upholstery is used.

Color Variations:
No two pieces of wood are identical. Variations in color-tone and grain pattern make a color or pattern match to any given sample impossible. While every effort is made to match wood grain as closely as possible, no two pieces of wood are exactly alike. These variations give wood its beauty and character.

Legal Disputes:
Parnian Furniture will not be held responsible for any merchandise or services not sold or supplied by Parnian on the sales order.

Any legal action instituted to interpret or enforce the terms of this agreement or which otherwise arises directly or indirectly, out of the purchase or sale of any merchandise or services described in this acknowledgement shall be venued in the County of Maricopa, State of Arizona. The prevailing party in such action shall be entitled to recovery of its reasonable attorney’s fees and costs in addition to any other recoverable damages.
